1. Scope

These general terms and conditions (hereafter referred to as “GTC”) of the Swiss Bankers Association (hereafter referred to as “SBA”) apply to all orders of goods placed in the SBA’s online shop ( as well as to Swiss Bankers’ Club events ( The designation “customer” refers to every natural and legal person who orders an item on offer in the online shop or who registers for an event in the Swiss Bankers’ Club.

Everything on offer on these websites is – unless otherwise indicated in these GTC – subject to change and non-binding. The SBA reserves the express right to wholly or in part change, modify or delete the offering without prior notice, or to discontinue possible publications temporarily or definitively.
Deviations from the GTC are only valid with a written confirmation from the SBA.
By ticking the check-box before completing the order or registration process, the customer confirms that he or she has read, understood and accepted the GTC.

2. Offers/conclusion of contract

The offers in the online shop and the Swiss Bankers’ Club represent a non-binding invitation to the customer to order goods or to register for events.

The ordering of the desired goods or registration for an event on the internet constitutes a binding offer by the customer to conclude a sales contract/a binding registration. The SBA reserves the right to decline the order/registration without having to cite the reasons for doing so.
Confirmation that the order/registration has been effectuated follows electronically by e-mail to the e-mail address that was indicated. The contract is only concluded, however, when the customer receives confirmation of purchase/registration.

3. Prices (territorial validity)

The prices published are in CHF and do not include statutory VAT. The offers apply exclusively to Switzerland and the Principality of Liechtenstein.

4. Payment

The customer will be invoiced the confirmed price after the item(s) has(ve) been dispatched/after the event.

5. Photographs

By participating at Swiss Bankers’ Club events, participants consent to being photographed and to the publication of such photographs on the SBA websites or in other publications. If a customer does not agree to this, he or she can ask for any such photographs to be deleted.

6. Exemption from liability

The SBA is liable solely for direct damages caused wilfully and resulting from gross negligence. Liability for indirect damages or damages resulting from negligence are excluded. Liability for auxiliary persons and third parties in charge is excluded to the extent permitted by the law.
Access at all times to the websites is not guaranteed.
The SBA’s websites can include links to third party websites. The SBA assumes no responsibility for these websites, their content, products on offer, services, or other offers, nor for the adherence to data protection rules on any such websites. The activation of an external link is done at the customer’s own risk.
Payments made by customers in the online shop or on are effectuated in a secure area in which the data transmitted are encrypted. Nevertheless, the SBA cannot guarantee the security of the payment system and is not liable for the security of the transmission of data, or damages arising from a possible misuse of the data.
The SBA strives to ensure the safe storage of personal data, which cannot, however, be guaranteed.

7. Rights to cancellation/withdrawal

The customer has the right to cancel or withdraw from orders placed in the online shop within 10 days after receipt of the delivery. The right to cancellation can be exercised in writing or by returning the merchandise within 10 days after consignment and requires no explanation. The merchandise must be in the same condition as when it was received by the customer. The return of the merchandise is at the customer’s expense.
In the case of registrations for events on, the customer also has the right to cancel/amend up to 48 hours prior to the event.

8. Intellectual property rights

All rights (copyrights, trademark rights, company and domain name rights) to the entire content of the SBA websites such as logos, photographs, texts, design, concept etc. are reserved by the SBA.
It is strictly prohibited to copy, download or otherwise use any part thereof for personal use unless prior written permission has been received from the SBA.

9. Data protection

The data submitted by the customer are used solely for the purpose of processing the orders/registrations. All data are handled strictly confidentially by the SBA. The data are shared with third parties (for example shipping companies) only if this is required for order processing.
The SBA respects the privacy of its customers and stores/processes their data in strict compliance with the applicable federal and cantonal data protection legislation.
The order data are encrypted and transferred in a secure manner, however, the SBA assumes no liability for the security of the data during their transmission over the internet (e.g. due to technical errors on the part of the provider) or for possible criminal access to data on its internet presence by third parties.

10. Applicable law and jurisdiction

All business dealings between the SBA and its customers are governed exclusively by Swiss substantive law with the exclusion of conflict of law provisions. The Vienna sales convention is expressly excluded. The exclusive place of jurisdiction is Basel.

11. Final provisions

In the case that individual provisions in these GTC should be invalid, the legal validity of the remaining provisions remain unaffected.
